1. Acceptance of Terms

By accessing or using TonePerfect ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Description of Service

TonePerfect is a Chinese pronunciation training application that helps users learn and practice Mandarin Chinese tones, initials, and finals through interactive exercises and AI-powered pronunciation feedback.

3. Account Registration

To access certain features of the App, you may need to create an account. You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

4. Subscription Terms

TonePerfect offers the following subscription plans:

  • Monthly subscription: $14.99 per month, auto-renewing
  • Annual subscription: $149.99 per year, auto-renewing

Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.

5. Payment and Billing

All payments are processed through the Apple App Store or Google Play Store, depending on your device. Payment will be charged to your App Store or Google Play account upon confirmation of purchase. By subscribing, you agree to the respective store's payment terms.

6. Cancellation Policy

You may cancel your subscription at any time through your App Store or Google Play account settings. Upon cancellation:

  • You will retain access to premium features until the end of your current billing period
  • No refunds will be provided for partial billing periods
  • You can continue to use the free features of the App after your subscription ends

7. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, audio clips, and software, are the exclusive property of TonePerfect and are protected by international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from the App without our prior written consent.

8. User Conduct

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the App
  • Interfere with or disrupt the App or servers
  • Reverse engineer or decompile any part of the App
  • Use the App in any way that could damage or impair the service

9. Limitation of Liability

To the maximum extent permitted by law, TonePerfect shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the App
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of transmission to or from the App
  • Any bugs, viruses, or other harmful code transmitted through the App

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, secure, or error-free, or that any defects will be corrected.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms of Use or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

12. Changes to Terms

We may modify these Terms of Use at any time. We will notify you of any material changes by posting the new terms in the App and updating the "Last updated" date. Your continued use of the App after such changes constitutes your acceptance of the new terms.

13. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
